  • manufacturing, publishing or supplier agreements;

  • GameCrowd transactions;

  • competitions or promotions with their own rules; or

  • third-party services reached through the website.

Those activities may be subject to separate terms made available before an order, booking, application or agreement is completed.

If separate terms conflict with these terms, the separate terms will apply to the relevant transaction or service.

4. Other policies

The following documents also apply when you use the website:

  • our Privacy Notice;

  • our Cookie Policy;

  • any applicable Terms of Sale;

  • any applicable Trade Terms and Conditions;

  • any service or booking terms presented before a paid appointment;

  • any specific submission, promotion or competition rules; and

  • any terms displayed beside a particular website feature.

5. Changes to these terms

We may update these terms to reflect:

  • changes to the website;

  • new or amended services;

  • changes in law or regulatory guidance;

  • changes to our security or moderation arrangements; or

  • clarification of existing wording.

The latest version will be published on this page with its revision date.

Material changes affecting registered users may also be communicated through the website or by email where reasonably appropriate.

Changes will not retrospectively remove rights that have already arisen under a completed purchase or agreement.

6. Website access and availability

We aim to keep the website available and functioning correctly, but we do not guarantee uninterrupted or error-free access.

We may suspend, restrict, change or withdraw all or part of the website where reasonably necessary for:

  • maintenance;

  • upgrades;

  • security;

  • legal or regulatory compliance;

  • investigation of misuse;

  • correction of faults;

  • discontinuation of a feature; or

  • circumstances outside our reasonable control.

Some website features may be described as a trial, preview, test or beta service. Such features may be changed or withdrawn.

We are not required to keep every product, page, listing, download or service permanently available.

7. Age and authority

People of different ages may browse information about our games.

However, you must be at least 18 years old to:

  • apply for a Trade account;

  • register as a supplier;

  • create a business, creator or professional profile;

  • claim or administer a business listing;

  • enter into a paid service agreement;

  • place an order unless a parent or guardian is responsible for it; or

  • submit information on behalf of a company or organisation.

If you are under 18, you should use the website with the involvement of a parent or guardian and should not submit personal or business information without their permission.

When acting for a business, club, creator, supplier or other organisation, you confirm that you have authority to act for it.

8. Accounts, passwords and access codes

Some features require an account, verification link, reset link, claim PIN, review PIN or other access credential.

You must:

  • provide accurate and current information;

  • keep passwords, PINs and access links confidential;

  • use only an account or listing you are authorised to use;

  • notify us promptly if you suspect unauthorised access;

  • keep your contact details reasonably up to date; and

  • log out or secure your device where appropriate.

You must not:

  • share an account with an unauthorised person;

  • impersonate another individual or organisation;

  • use false business or identity information;

  • attempt to claim a listing you do not control;

  • access another user’s private information;

  • circumvent account restrictions; or

  • create multiple accounts to evade moderation, suspension or other controls.

You are responsible for activity carried out through your credentials where that activity results from your failure to keep them secure.

We may require additional verification before allowing access to an account, profile or listing.

9. Acceptable use

You may use the website only for lawful purposes.

You must not use the website:

  • in breach of any applicable law or regulation;

  • to commit, encourage, assist or facilitate unlawful activity;

  • to deceive, defraud, threaten, harass or intimidate anyone;

  • to impersonate another person or misrepresent your authority;

  • to publish false, misleading or materially incomplete business information;

  • to infringe copyright, trade marks, privacy, confidentiality or other rights;

  • to submit defamatory, discriminatory, hateful, obscene or abusive material;

  • to distribute spam, unsolicited marketing or pyramid schemes;

  • to collect personal contact information for unsolicited outreach;

  • to upload malware, malicious code or harmful files;

  • to interfere with the security or operation of the website;

  • to probe, scan or test our systems without written authorisation;

  • to obtain unauthorised access to any server, database, account or administrative area;

  • to overload the website or deliberately reduce its availability;

  • to bypass rate limits, access controls, moderation or security measures;

  • to manipulate votes, reviews, comments, rankings or directory information;

  • to submit fake reviews or endorsements;

  • to conceal a commercial connection that should reasonably be disclosed; or

  • in any other manner that harms Blue Donut Games, its users or third parties.

10. Automated access, scraping and artificial intelligence

Ordinary use by recognised search engines, accessibility tools and standard web browsers is permitted, subject to our technical controls and robots instructions.

Without our prior written permission, you must not use automated systems to:

  • scrape or harvest the website;

  • extract business or personal contact information;

  • copy the Store Locator, Supplier Database or Creator Database;

  • create a competing directory or dataset;

  • send automated enquiries or submissions;

  • monitor accounts or restricted areas;

  • reproduce substantial parts of our catalogue;

  • generate unsolicited sales or marketing lists;

  • circumvent technical restrictions; or

  • place an unreasonable burden on the website.

Except where a use is expressly permitted by law and cannot lawfully be restricted, we reserve all rights relating to the use of website content for:

  • text and data mining;

  • machine-learning datasets;

  • training, testing or evaluating artificial intelligence systems;

  • retrieval-augmented generation databases;

  • synthetic-content systems; and

  • automated commercial analysis.

Website content, images, product information, directory information and downloads must not be used to train or operate an artificial intelligence model without our prior written permission.

11. Information and content you submit

“Submitted Content” means information, text, comments, descriptions, reviews, images, videos, logos, links, schedules, files and other materials you provide through the website.

You retain ownership of rights you hold in your Submitted Content.

By submitting content, you confirm that:

  • it is accurate to the best of your knowledge;

  • you have the right and authority to submit it;

  • publication will not infringe another person’s rights;

  • any individuals shown or identified have given appropriate permission;

  • it does not contain confidential information you are not authorised to disclose;

  • it does not contain unlawful, misleading, defamatory or harmful material;

  • it does not contain malicious code;

  • any commercial relationship or incentive has been disclosed where relevant; and

  • it complies with these terms.

You remain responsible for your Submitted Content.

12. Permission to use Submitted Content

When you ask us to publish Submitted Content, you grant Blue Donut Games a non-exclusive, worldwide, royalty-free licence to:

  • store it;

  • reproduce it;

  • display and publish it;

  • format and resize it;

  • make reasonable accessibility adaptations;

  • correct obvious spelling or formatting errors;

  • include it in search results, listings and email roundups;

  • promote the relevant listing, profile, product or website feature; and

  • make backup or archival copies.

This licence is limited to operating, administering and promoting Blue Donut Games and the relevant website services.

You may ask us to remove your Submitted Content. We will consider the request and remove it where reasonably possible, subject to:

  • legal and record-keeping obligations;

  • the rights of other people;

  • completed publications or communications;

  • dispute or enforcement records; and

  • temporary retention in protected backups.

Removing Submitted Content does not affect lawful uses made before removal.

13. Confidential material and unsolicited ideas

Public forms and general contact channels are not intended for confidential information.

We do not claim ownership of an original game idea merely because you contact us about it. However:

  • unsolicited ideas and materials are not automatically treated as confidential;

  • submitting an idea does not create a partnership, agency, employment or development agreement;

  • submitting an idea does not prevent us from developing, publishing or discussing similar material created independently; and

  • no payment or other obligation arises unless we agree it in writing.

Do not submit unpublished rules, prototypes, commercial secrets or other confidential material unless we have agreed in writing how it will be handled.

Paid consultancy, development or support services may have separate confidentiality and intellectual-property terms.

14. Moderation and publication

Public comments, reviews, listings and profiles may be reviewed before publication.

We may:

  • approve or reject a submission;

  • request clarification or evidence;

  • correct formatting or obvious typographical errors;

  • remove personal information that should not be public;

  • delay publication while information is checked;

  • restrict the visibility of content;

  • remove content;

  • suspend the associated account or listing; or

  • preserve relevant information for a legal, safety or regulatory purpose.

We are not obliged to publish every submission.

Moderation does not mean that we endorse, verify or accept responsibility for Submitted Content.

Although we take reasonable steps to review content, we do not guarantee that every published statement is complete, accurate or lawful.

15. Illegal and harmful content

You must not submit, link to or use the website to facilitate content or conduct involving:

  • terrorism;

  • child sexual exploitation or abuse;

  • grooming;

  • fraud or financial crime;

  • threats, stalking or harassment;

  • unlawful discrimination or hatred;

  • intimate-image abuse;

  • sexual exploitation;

  • trafficking;

  • unlawful drugs;

  • unlawful weapons;

  • encouragement or assistance of suicide or serious self-harm;

  • animal cruelty;

  • malicious communications;

  • copyright or trade-mark infringement;

  • unlawful disclosure of personal information; or

  • any other criminal or unlawful activity.

This list is not exhaustive.

We may remove or restrict content where we reasonably believe it:

  • is unlawful;

  • breaches these terms;

  • creates a material safety or security risk;

  • infringes another person’s rights;

  • is fraudulent or misleading;

  • is inappropriate for the intended website service; or

  • exposes us or another person to legal or regulatory risk.

Where we become aware of suspected illegal content, we will assess it and take proportionate action. This may include removal, restriction, preservation of evidence, suspension of access and reporting to an appropriate authority where required or justified.

16. Reporting content and making a complaint

Anyone may report content they believe is illegal, harmful, inaccurate, infringing or contrary to these terms.

Reports can be sent to info@bluedonutstudios.com.

Please provide, where possible:

  • the page or content concerned;

  • a direct link or screenshot;

  • the reason for the report;

  • details of any rights you believe are affected;

  • supporting evidence; and

  • your contact information.

We will review reports in a proportionate manner.

Depending on the circumstances, we may:

  • ask for further information;

  • remove or restrict content;

  • correct factual information;

  • contact the person who submitted the content;

  • reject a report that is clearly unfounded;

  • preserve relevant records;

  • suspend an account or listing; or

  • refer the matter to an appropriate authority.

A user may also complain where:

  • their content has been rejected or removed;

  • their account or listing has been restricted;

  • they believe we have failed to act on prohibited content;

  • they believe these terms have been applied inconsistently; or

  • they believe an automated or administrative error has occurred.

Where we communicate a moderation decision, the affected user may request a review by replying or writing to us within 30 days. Reviews will be considered by a person who was not solely responsible for the original decision where reasonably practicable.

We may withhold details where disclosure would:

  • breach the law;

  • compromise security;

  • expose another person’s private information;

  • prejudice an investigation; or

  • create a risk of harm.

17. Store Locator and community listings

The Store Locator and Community directories may include shops, cafés, clubs, venues, festivals and events.

Some entries may be:

  • submitted by the organisation;

  • submitted by a customer or community member;

  • imported from publicly available business information; or

  • created from a retailer or distributor list.

A listing does not mean that Blue Donut Games:

  • owns or controls the organisation;

  • endorses it;

  • guarantees its products or services;

  • confirms its opening hours;

  • confirms that a particular game is in stock;

  • guarantees accessibility or facilities;

  • guarantees that an event will take place; or

  • accepts responsibility for transactions with it.

Information can change without notice. You should confirm important details directly before travelling, attending an event or making a purchase.

Listing owners may request correction, claim or removal of an entry.

18. Supplier and Creator Databases

Supplier and creator profiles are provided as discovery and contact resources.

Unless expressly stated otherwise, inclusion does not mean that we have:

  • audited the business;

  • verified every claim;

  • approved its work;

  • checked its financial position;

  • confirmed insurance or professional qualifications;

  • guaranteed availability;

  • guaranteed prices or delivery;

  • endorsed its opinions or reviews; or

  • accepted responsibility for its services.

You must carry out your own checks before engaging a supplier, creator or other third party.

Any contract entered into with a listed organisation is between you and that organisation unless Blue Donut Games expressly agrees otherwise in writing.

19. Product votes, comments and expressions of interest

A product vote or expression of interest:

  • is not a purchase;

  • does not reserve a product;

  • does not create a crowdfunding pledge;

  • does not guarantee production;

  • does not guarantee a release date;

  • does not fix a price;

  • does not give ownership or approval rights; and

  • does not oblige either party to enter into a future contract.

Votes and comments may be used to understand demand and inform product-development decisions.

We may decide not to develop, manufacture or release a product regardless of the number of votes received.

20. Reviews and endorsements

Reviews and creator content represent the views of their authors unless expressly stated otherwise.

Anyone submitting a review, recommendation or endorsement must disclose any relevant commercial relationship, free product, payment, sponsorship or other material incentive.

You must not submit or arrange:

  • fake reviews;

  • reviews by people who have not had a genuine relevant experience;

  • undisclosed paid endorsements;

  • coordinated review manipulation;

  • misleading star ratings;

  • reviews intended to impersonate another person; or

  • incentives conditional on a positive review.

We may remove reviews that we reasonably believe are fake, misleading or improperly incentivised.

21. Downloads and print-and-play files

Unless a download states otherwise, Blue Donut Games grants you a limited, revocable, non-exclusive licence to download and use it for:

  • personal use;

  • private game play;

  • non-commercial club activity;

  • non-commercial demonstrations; and

  • classroom or educational use where the file is presented for that purpose.

You must not, without prior written permission:

  • sell a downloaded file;

  • sell printed copies;

  • redistribute the original file;

  • upload it to another website or file-sharing service;

  • remove copyright or trade-mark notices;

  • claim the material as your own;

  • use it to manufacture commercial products;

  • modify and distribute a derivative version; or

  • use it primarily for commercial gain.

You may share a link to the relevant download page.

Additional licence terms shown with a particular file take priority over this general permission.

22. Intellectual property

Unless otherwise stated, the website and its contents are owned by or licensed to Blue Donut Studios Limited.

This includes:

  • website text;

  • game designs and game material;

  • product descriptions;

  • illustrations and photographs;

  • logos and branding;

  • page design;

  • databases and directory organisation;

  • downloadable files;

  • software and source code; and

  • trade marks.

All rights are reserved.

Horror in the Library® is a registered trade mark of Blue Donut Studios Limited.

You may view and use the website for its intended purpose.

You must not reproduce, publish, distribute, license, sell, commercially exploit or create derivative works from substantial parts of the website without our prior written permission, except where the law expressly permits the use.

Nothing in these terms transfers ownership of our intellectual property to you.

23. Linking to the website

You may link to a public page of the website provided that the link:

  • is lawful and fair;

  • does not damage our reputation;

  • does not falsely suggest endorsement, partnership or approval;

  • does not display our content in a misleading context;

  • does not bypass access restrictions; and

  • does not reproduce a substantial part of the website.

You must not frame the website within another website or present our pages as part of another service without permission.

We may ask for a link to be removed where it breaches these conditions.

24. External websites and services

The website may link to services operated by other organisations, including:

  • payment services;

  • booking platforms;

  • social networks;

  • video platforms;

  • Tabletopia;

  • retailers;

  • publishers;

  • suppliers;

  • creators;

  • clubs;

  • events; and

  • external game websites.

External links are provided for convenience and information.

We do not control external websites and are not responsible for:

  • their availability;

  • their content;

  • their privacy practices;

  • their security;

  • their products or services; or

  • any loss arising from your dealings with them.

A link does not necessarily constitute endorsement.

You should read the relevant external terms and privacy information before using another service.

25. Website information and reliance

We take reasonable care when preparing our own website content, but general website information is provided for information only.

It is not a substitute for:

  • legal advice;

  • financial or investment advice;

  • tax advice;

  • medical advice;

  • safety instructions supplied with a product;

  • professional manufacturing advice; or

  • advice tailored to your circumstances.

Product development, publishing, manufacturing, crowdfunding and marketing involve commercial risk. Information about these subjects does not guarantee a particular result.

You should obtain appropriate professional advice before making a significant commercial, legal or financial decision.

Paid advice and support sessions are governed by their own descriptions and applicable service terms.

26. Security and viruses

We take reasonable measures to protect the website, but cannot guarantee that it will always be completely secure or free from faults or malicious material.

You are responsible for:

  • maintaining appropriate device security;

  • using current software;

  • protecting your credentials;

  • maintaining your own backups; and

  • checking downloaded files where appropriate.

You must not knowingly introduce viruses, trojans, worms, ransomware, logic bombs or other harmful material.

Security concerns may be reported privately to info@bluedonutstudios.com. Do not publicly disclose an uncorrected vulnerability in a manner that creates avoidable risk to users.

27. Suspension and termination

We may suspend or terminate an account, profile, listing or access to a website function where we reasonably believe that:

  • these terms have been breached;

  • information is false or misleading;

  • an account is compromised;

  • an account is being used without authority;

  • unlawful or harmful content has been submitted;

  • the website or another user is at risk;

  • payment or account fraud is suspected;

  • continued access would expose us to legal or regulatory risk; or

  • suspension is necessary to investigate a complaint.

Where reasonably appropriate, we will explain the reason and provide an opportunity to respond.

We may act without prior notice where immediate action is reasonably necessary for security, safety, legal compliance or prevention of harm.

Termination does not affect rights or obligations that arose before termination.

28. Our responsibility to consumers

Nothing in these terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • breach of legal rights that cannot lawfully be excluded;

  • defective products where liability cannot lawfully be excluded; or

  • any other matter for which liability cannot lawfully be limited.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for loss that:

  • was not reasonably foreseeable;

  • was caused by information supplied by you;

  • resulted from your breach of these terms;

  • could reasonably have been avoided by following our instructions; or

  • arises from a third-party organisation that we do not control.

The website is principally provided for private and business information purposes. If you use a free website feature for commercial purposes, we are not responsible under these consumer provisions for business losses such as lost profit, revenue, opportunity or goodwill.

Your statutory consumer rights are not affected.

29. Our responsibility to business users

This section applies where you use the website wholly or mainly for business, trade, craft or professional purposes.

To the fullest extent permitted by law:

  • the website is provided without implied guarantees beyond those that cannot lawfully be excluded;

  • we do not guarantee that the website will meet every business requirement;

  • we are not responsible for decisions made solely in reliance on general website information;

  • we are not liable for indirect or consequential losses;

  • we are not liable for loss of profit, revenue, sales, contracts, opportunity, anticipated savings, goodwill or reputation arising solely from use of the free website;

  • we are not liable for loss caused by an independent supplier, creator, retailer, venue or other third party; and

  • we are not liable for loss resulting from unauthorised use of credentials caused by your failure to keep them secure.

Liability arising from a paid product, Trade order or paid service is governed by the terms applying to that transaction.

Nothing in this section excludes liability that cannot lawfully be excluded.

30. Your responsibility

You are responsible for your use of the website and your Submitted Content.

If you are a business user, you will be responsible for reasonable losses, liabilities and costs incurred by us as a direct result of:

  • your unlawful use of the website;

  • Submitted Content that infringes another person’s rights;

  • your material breach of these terms; or

  • your misuse of another organisation’s account or listing.

This does not make you responsible for loss caused by our own negligence, breach or unlawful conduct.

31. Privacy and cookies

We process personal information in accordance with our Privacy Notice.

We use cookies and similar technologies as described in our Cookie Policy.

Submitting public information may result in that information being visible to other users and indexed by search engines.

Do not include private information in a public description, review, comment or image unless you are authorised and genuinely want it to be public.

32. Events outside our reasonable control

We are not responsible for delay or failure caused by circumstances outside our reasonable control, including:

  • internet or hosting failures;

  • power failures;

  • cyberattacks;

  • failures of external payment or booking services;

  • industrial disputes;

  • natural disasters;

  • public-health emergencies;

  • government action; or

  • failure of telecommunications networks.

This clause does not remove legal rights relating to an order or paid service where the law provides otherwise.

33. Governing law and courts

These terms are governed by the law of England and Wales.

If you are a consumer living in England or Wales, the courts of England and Wales will normally have jurisdiction.

If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.

If you are a business user, the courts of England and Wales will have exclusive jurisdiction over disputes concerning these terms and use of the website.

Mandatory consumer protections in the country where you live are not removed where the law requires them to apply.

34. General provisions

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A delay in enforcing these terms does not waive the right to enforce them later.

You may not transfer your account or rights under these terms without our permission.

We may transfer responsibility for operating the website as part of a genuine company restructure, merger or sale, provided that your legal rights are not reduced.

These terms do not create a partnership, joint venture, employment relationship or agency relationship.

Except where the law provides otherwise, a person who is not a party to these terms does not have a right to enforce them.
